Former Masindi LCV candidate petitions court challenging opponent’s victory


MASINDI- The former candidate for Masindi district chairperson race Wilson Isingoma Mugimba has petitioned the court challenging the election of Cosmas Byaruhanga.

Mugimba who lost to Cosmas in the January 20th elections has jointly sued Cosmas with the electoral commission in a petition filed on Monday.

Cosmas polled 35,635 votes representing 67% against Mugimba’s 14,452 votes representing 27% as Lenox Mugume and independent got 1389 votes while Tom Kiweesi of FDC got 1097 votes in the same race.

In the copy of petition which was seen by our reporter, Mugimba contends that Cosmas was illegally nominated by the electoral commission as the flag bearer for NRM for the post.

He  also contends that the nomination of Cosmas by the electoral commission amounted to contempt of a court order after the NRM election dispute tribunal had declared him the NRM flag bearer  for that the post. 

Mugimba adds that the illegal nomination of Cosmas as the NRM flag bearer by the electoral commission resulted into his losing the election as he was telling his supporters to vote a person with the NRM symbols yet the electoral body had not complied with the court order that declared him as the NRM flag bearer.

Mugimba therefore wants the court to nullify Cosmas’s election and also award him costs and damages. Mugimba confirmed the petitioning court against Cosmas’s election victory but declined to divulge details.

However Mugimba had earlier conceded defeat in the election and said he was going back to his farming business.

Meanwhile Cosmas said he has been served the copy of the petition adding his lawyers are studying it and preparing his defense. 

Mugimba lost to Cosmas in the NRM primaries for the same post before petitioning the NRM election dispute tribunal citing malpractices that later nullified his election and handed him the flag.

However Mugimba Cosmas had been nominated for the post as the NRM candidate by the electoral commission.
